On 20 January 2021, within the a posteriori constitutional review, the Constitutional Court unanimously upheld the exception of unconstitutionality and found that the phrase “on the date of initial registration for the right to pensioncontained in Article IV (2) of the Government Emergency Ordinance No 1/2013 amending and completing Law No 263/2010 on the unitary system of public pensions is constitutional, as concerns the beneficiaries of the invalidity pensions, in so far as it is interpreted that it refers to the establishment of the old-age pension by applying, for the first time, the conditions of the legal retirement age and the full contributions stipulated by Law No 263/2010.

The decision is final and generally binding.
